Terms of Service

By accessing digitalmarketingdhaka.com or engaging Digital Marketing Dhaka Ltd. ("DMD", "we", "us") for any service, you agree to these Terms of Service. If you accept these terms on behalf of a company, you confirm you have authority to bind that company.

DMD provides SEO, paid media (Google Ads, Meta, TikTok, LinkedIn), social media, content, video, eCommerce growth, analytics, CRO, AI and web/app development. The specific deliverables, KPIs, fees and timelines are defined in a signed proposal or Statement of Work (SOW), which prevails over anything on the Site.

Agency fees are invoiced in BDT (or USD for international clients) per the SOW — usually a monthly retainer paid in advance. Media spend on Google, Meta and other ad networks is billed at cost and is separate from agency fees.

Overdue invoices may pause active campaigns and delivery until settled.

• • Provide timely access to accounts, assets, approvals and information required for delivery.
• • Ensure content, brand assets, offers and claims supplied to us are accurate and lawful.
• • Comply with platform policies (Google, Meta, TikTok, LinkedIn, YouTube, etc.).
• • Designate a single point of contact empowered to approve strategy and creative.

Site content, brand marks and case-study materials remain the property of DMD or the respective rights-holders. Deliverables produced for a client under a paid SOW transfer to that client on full payment, except for our pre-existing tools, templates, frameworks and methodologies, which remain ours.

Each party will keep the other's non-public information confidential and use it only to perform the engagement. A separate NDA can be signed on request.

We commit to skilled, honest execution but cannot guarantee specific rankings, ROAS or revenue outcomes — results depend on the offer, product, market, competition and factors outside our control. The Site and services are provided "as is" without warranties of any kind, express or implied.

To the maximum extent permitted by law, DMD's aggregate liability for any claim relating to the Site or services is limited to the fees paid to us in the three (3) months preceding the claim. We are not liable for indirect, incidental, special or consequential losses, including lost profits or lost data.

Either party may terminate an engagement per the notice period in the SOW (typically 30 days written notice). Fees for work performed and committed media spend up to the termination date remain payable.

These terms are governed by the laws of Bangladesh. Any dispute will be handled by the courts of Dhaka, unless both parties agree in writing to arbitration.

We may update these terms from time to time. Continued use of the Site after an update means you accept the revised terms.
